November 2022 – West Virginia Policy Update

The 2022 West Virginia Legislative session wrapped up on March 12 without advancing key legislation to promote energy efficiency including a bill that would have required electric utilities to develop and implement programs to achieve an overall energy reduction of 9% by 2032, compared to 2020 usage (see HB 4040). The other, HB 2533, proposed a tax credit to support green building renovations and improvements in commercial buildings. Neither bill saw a vote in Committee before the session adjourned.

Bills considered but not passed in 2022:

• HB 2533 Green Building Rating Tax Credit would create a tax credit for individuals and small businesses to make renovations and improvements to commercial buildings to obtain certifications from the US Green Building Council or from the Green Globes Building Initiative. The bill does not yet specify which certifications qualify for the credit, but it is only applicable to be applied to commercial buildings. The bill was introduced on January 12th to the House Finance and Government Organization Committees.
• HB 4040 WV Energy Efficiency Jobs Creation Act would mandate electric utilities to develop and implement programs that promote energy efficiency and conservation efforts to achieve an overall energy reduction of 9% by 2032, compared to 2020 usage. HB 4040 was prefiled to the House Technology and Infrastructure Committee on January 12th.
